29/09/16 Patent Infringement

Word for word extracts of mail communications in relation to Intellectual Property Rights regarding Patent Infringement in the US.

Ian,

I received the response below from Zenport. I would suggest responding by e-mail requesting that they notify their dealers to remove the item from their offerings, and that provided we do not see further activity in connection with marketing or sale of this product we will consider the matter closed. Please let me know if you want to discuss.

Regards, Tom

....

Good day Thomas,

We received your faxes concerning your file number 8705G001 and the Grafter Crafter Tool. A trading company in Asia sent us a sample of this tool back in June and we put it on our webpage to gauge interest. Some of our online dealers followed suit. The supplier of this tool said that they had it patented in Japan, Taiwan and China and wanted us to see if it would sell in North America. We had no idea that you folks have a similar tool that is patented in New Zealand and the United States. We immediately took it off of our website and notified the online dealers to do so, as well. We have not sold the unit we have, nor did we get any interest in it from existing dealers.

We actually broke the unit in testing it.

I called the trading company and told them of this situation a month ago and they said they would get back to me. They never did.

Thank you, Randy Killion Zenport industries Tigard, OR
